Terms of Use

These Terms of Use ("Terms") govern your access to and use of Learny, including the Learny mobile application, website, AI avatar features, chats, quizzes, games, Stars, subscriptions, and related services.

Learny is operated by Learny Technologies LLC ("Learny", "we", "us", or "our").

By creating an account, downloading the app, accessing the website, purchasing a subscription, starting a free trial, or using any Learny service, you agree to these Terms.

If you do not agree to these Terms, do not use Learny.

Learny is an AI-powered learning companion designed to support learning through AI avatars, text and voice-based interaction, AI-generated conversations, quizzes, games, learning topics, progress mechanics, Stars and reward features, avatar-related experiences, and Premium and Super Premium subscription features.

Learny is intended to make learning more interactive, engaging, and personalized.

Learny is not a school, university, official educational institution, medical service, psychological service, tutoring certification provider, or professional advisory service.

Learny is intended for users aged 13 years and older. By using Learny, you confirm that you meet the eligibility requirements.

• you are at least 13 years old
• you are legally allowed to use Learny in your country or region
• if you are under the age of digital consent in your country or region, you have permission from a parent or legal guardian
• the information you provide is accurate and complete

To use certain Learny features, you may need to create an account. Learny may use Firebase Authentication or other authentication providers to manage account access.

• not share your account with unauthorized users
• notify us if you suspect unauthorized access
• be responsible for activity under your account

You are responsible for how you use Learny. We may restrict, suspend, or terminate access if we believe the service is being misused.

• do not use Learny for illegal, harmful, abusive, or fraudulent purposes
• do not attempt to bypass subscriptions, limits, paywalls, or technical restrictions
• do not misuse AI chat features
• do not submit harmful, violent, sexual, exploitative, hateful, or illegal content
• do not harass, threaten, or abuse others
• do not impersonate another person
• do not interfere with app security or infrastructure
• do not reverse engineer or attempt to extract source code
• do not use Learny to generate content that violates laws or third-party rights
• do not use automated systems, bots, scraping, or unauthorized access tools
• do not exploit bugs, vulnerabilities, or unintended reward mechanics

Learny uses AI systems and third-party AI providers, including DeepSeek, to generate responses and learning interactions.

AI-generated content may include explanations, answers, educational guidance, conversational replies, quiz-related support, game-related responses, and avatar dialogue.

AI-generated content may be incorrect, incomplete, outdated, inappropriate, or unsuitable in some cases.

• Learny is not a replacement for teachers, parents, tutors, doctors, psychologists, or professional advisors
• users and parents/guardians should review important information independently

Learny may allow voice input. Learny will request microphone permission only when you attempt to use a voice-related feature. You can manage microphone access through your device settings.

• spoken input is converted into text
• Learny receives the converted text message
• Learny does not store your voice audio recordings on our servers
• the resulting text may be processed like any other chat message

Learny may provide learning activities, topics, quizzes, games, and AI-assisted explanations. Learny is intended as a supportive educational tool. Users, parents, and guardians remain responsible for evaluating the suitability of Learny content.

• Learny does not guarantee that all explanations are complete
• Learny does not guarantee that all content matches a specific school curriculum
• Learny does not guarantee that all content is suitable for every user
• Learny does not guarantee that use of Learny will improve grades or academic results
• Learny does not guarantee that progress indicators represent formal educational assessment

Learny may offer a free plan with limited access. Free usage is provided at Learny's discretion and may be changed, reduced, paused, or discontinued.

Learny may apply message limits to free users. Learny may adjust these limits, thresholds, timers, and access rules for product, business, safety, technical, service-capacity, or operating-cost reasons. Premium or Super Premium may remove certain limits, depending on the subscription plan.

Learny may apply limits to free game sessions. Free users may receive a limited number of game sessions per day or per period. Learny may change game session limits, refresh timing, and availability at any time.

Learny may include AI avatars connected to learning topics. Some avatars, topics, or avatar-related features may be free, while others may require an unlock, Premium, Super Premium, future in-app purchase, or other access condition. Learny may add, remove, modify, rename, rebalance, or restrict avatars and topics at any time.

Learny may offer a Premium subscription.

Premium is generally intended for users who want unlimited usage with one selected or current avatar.

Premium does not necessarily include access to all avatars, all avatar topics, all shop items, all future features, or all digital content unless specifically stated in the app at the time of purchase.

The exact Premium benefits will be shown in the app before purchase.

Learny may offer a Super Premium subscription.

Super Premium is generally intended for users who want the full Learny experience.

The exact Super Premium benefits will be shown in the app before purchase.

Super Premium does not automatically include separate paid shop items, future paid add-ons, external services, or items clearly marked as separate purchases unless explicitly stated.

Learny may offer a 3-day free trial for Super Premium. The exact trial terms will be displayed in the app or app store purchase screen before you confirm the trial. Learny may change, remove, or limit free trial availability at any time.

• the trial lasts 3 days unless stated otherwise in the app
• the trial may be available only to eligible users
• the trial may be limited to one use per user or account
• after the trial ends, it may automatically convert into a paid subscription unless cancelled before the trial ends
• billing is handled by Apple App Store or Google Play
• cancellation must be completed through the applicable app store before the trial ends to avoid being charged

Learny subscriptions are processed through Apple App Store and Google Play.

We do not process payments directly and do not store full payment card details.

Subscriptions may automatically renew unless cancelled according to the rules of the applicable app store.

You are responsible for managing and cancelling your subscription through Apple App Store or Google Play.

Cancellation steps, billing rules, renewal timing, refund eligibility, and payment disputes are governed by the applicable app store provider.

Refunds are handled by Apple or Google according to their policies.

Learny cannot guarantee refunds for purchases made through Apple App Store or Google Play.

Prices may vary by country, currency, taxes, platform, app store rules, promotions, and subscription type. Prices are shown before purchase in the app or app store checkout screen.

Learny may allow users to unlock individual avatars separately. The exact benefits of an individual avatar unlock will be shown before purchase or unlock. Individual avatar unlocks may provide access to a specific avatar, that avatar's topics, related avatar experiences, and related chat/game access depending on the current product version.

Learny may include an in-app reward mechanic called Stars. Stars may be earned through learning-related activity, such as quizzes, games, lessons, learning progress, streaks, challenges, and other app activities. Stars are used as a motivational feature inside Learny.

• Stars are not cryptocurrency
• Stars are not financial instruments
• Stars are not stored value
• Stars are not gambling tokens
• Stars are not real-world currency
• Stars are not redeemable for cash
• Stars are not transferable outside Learny

Learny may include a Star Shop. At the current stage, Star Shop may function as a preview or motivational feature. Shop items may include visual or customization-related concepts such as avatars, outfits, voices, emojis, effects, playful rewards, and other digital items.

• Shop may display preview items or future unlock possibilities
• Shop does not guarantee permanent availability of any item

Learny may offer digital items, customization, avatars, voices, outfits, badges, rewards, or other virtual features. Learny may modify digital items or access rules when necessary for product, safety, legal, business, or technical reasons.

• digital items may be changed, removed, replaced, or limited
• digital items may depend on account status, subscription status, product version, region, or availability
• digital items are not property in the traditional sense
• digital items may not be transferable, sellable, or exchangeable outside Learny

You may submit text or other content into Learny, including messages to AI avatars. You are responsible for the content you submit. By submitting content, you grant Learny a limited right to process, store, display, and use that content as needed to provide and operate the service.

Learny and its content, design, code, avatars, branding, visual assets, features, systems, text, UI, graphics, and software are owned by Learny or its licensors. Using Learny does not give you ownership of Learny intellectual property.

• do not reproduce or redistribute app assets
• do not reverse engineer the app
• do not use Learny branding without permission
• do not create derivative products based on Learny
• do not extract datasets, prompts, avatars, or AI behavior systems
• do not use Learny content for competing services

Subject to these Terms, Learny grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial learning purposes.

Learny may change, suspend, or discontinue any part of the service at any time. Learny may perform maintenance, updates, experiments, or feature changes without prior notice.

• we do not guarantee Learny will always be compatible with every device

Learny may use automated systems, AI safety rules, moderation tools, or manual review where appropriate to protect users and the service. We do not guarantee that all harmful or inappropriate content will always be detected.

• abusive
• inappropriate
• illegal
• harmful to minors
• exploitative
• fraudulent
• disruptive
• violating these Terms

Learny is intended for users aged 13 and older. If a minor uses Learny, parents or legal guardians are responsible for determining whether Learny is appropriate for that user. Learny is a learning support tool and does not replace parental guidance.

• managing subscriptions and app store purchases
• ensuring safe and responsible use
• understanding that AI-generated content may be imperfect

You may delete your account through the app or by contacting us at support@learny.tech. When your account is deleted, Learny deletes user-related data associated with the account, subject to limited exceptions.

Learny may suspend, restrict, or terminate your account or access if needed for legal, safety, business, product, or misuse-related reasons. If your account is terminated, you may lose access to app data and features. Subscription cancellation and refund handling remain subject to Apple or Google policies.

• we discontinue the service
• your account appears fraudulent or unsafe

Learny is an evolving product. We may add, remove, rename, redesign, or modify plans, prices, free limits, paid features, avatars, topics, games, Stars, Star Shop, learning activities, subscriptions, trials, rewards, progress mechanics, UI flows, and app availability. We will try to avoid materially reducing paid features during an active subscription period unless necessary for legal, technical, safety, app store, or business reasons.

Learny may depend on third-party services. Your use of Learny may involve third-party systems, policies, and terms. Learny is not responsible for third-party service outages, policies, payment decisions, refunds, app store rules, or infrastructure failures outside our control.

Learny is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of any kind. You use Learny at your own risk.

• content will always be appropriate
• service will be uninterrupted
• service will be error-free
• all bugs will be fixed
• all features will remain available
• data will never be lost

To the fullest extent permitted by law, Learny Technologies LLC and its owners, directors, employees, contractors, partners, and service providers will not be liable for indirect damages, incidental damages, special damages, consequential damages, lost profits, lost data, loss of progress, loss of Stars or digital items, subscription issues caused by app stores, AI-generated inaccuracies, educational outcomes, device issues, third-party service failures, or unauthorized account access caused by user negligence. Our total liability, where liability cannot be excluded, will be limited to the amount you paid to Learny for the service during the relevant period, unless applicable law requires otherwise.

You agree to defend, indemnify, and hold harmless Learny Technologies LLC from claims, damages, losses, liabilities, costs, and expenses arising from your use of Learny, your violation of these Terms, your submitted content, your misuse of AI features, your violation of another person's rights, or your violation of laws or regulations.

If you download Learny from Apple App Store or Google Play, your use of Learny is also subject to the applicable app store terms. Apple and Google are not responsible for Learny's content, support, or claims, except as required by their own rules. Subscription billing, renewals, cancellations, refunds, and payment disputes are handled through the applicable app store.

These Terms are governed by the laws of Ukraine, unless mandatory consumer protection laws in your country require otherwise. If any dispute arises, we encourage you to contact us first at support@learny.tech. We will try to resolve the issue informally where possible.

We may update these Terms from time to time. If we make material changes, we may notify you through the app, website, email, or another appropriate method. The updated Terms will become effective when posted unless stated otherwise. Your continued use of Learny after the updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using Learny.
